The Islāmic-Clarification of Marital-Rape

This is something which had been on my Mind/Heart for a Long-Time, regarding precisely how to tackle it. There’s 2 Polarizing Stances holistically as per This-Issue: a. That there’s no such Thing as Marital-Rape…b. That Marital-Rape is anything which any Woman says that it is. Both are Equally-Negative/Toxic Interpretations. This-Conversation will (no Doubt at all) be something Extremely-Risky, because if one is apathetic/careless, they can easily be stigmatized/accused as being a “Sympathizer/Proponent” of Rape-Culture. Even for me personally: for me to dare address this Type/Kind of Issue is quite dangerous for me. It’s something which can yield a Significant-Amount of Backlash, which can backfire in a Terrible-Way absolutely not in my Favor. The Subject of “Marital-Rape” is, by default, very controversial for Obvious-Reasons. It’s something which I (via my Profession as a Chaplain [Counselor/Therapist]) am very familiarized with. Likewise, because of my Position as a Chaplain: this is something that has potential to alienate me astronomically. I’ve literally counseled Countless-Persons regarding This-Issue. And, there’s 0-Doubt concerning how much of a Necessity it is to educate Others (Men especially) the Reality of This-Issue. The 1st-Thing which must be recognized/accepted is that Marital-Rape is a Real-Thing & there’s 0 Islāmic-Justification to deny this. The 2nd-Thing is that “Marital-Rape” must be accurately&honestly defined. The 3rd-Thing is that “Marital-Rape” must be understood via the Context of ash-Sharī`ah/Islāmic-Law, as opposed to Secular-Law. The 4th-Thing is that “Marital-Rape” must be compared/contrasted to Sexual-Abuse & must be examined as per if/how it’s Islāmically-Punishable. I plan to purposely ruffle the Feathers of Lots of People, because Convos like this must be had & being soft about it just can’t/won’t get it done.

Defining “Marital-Rape”

Any&all Sexual-Contact/Acts imposed upon Spouses without Sexual-Consent.

Defining al-Ightisāb/Sexual-Abuse:

Any&all Sexual-Contact which is imposed upon Others without Sexual-Consent (Necrophilia, Bestiality, Child-Molestation, Rape, Sex-Trafficking/Prostitution, etc.).

Contextualizing “Marital-Rape”

Marital-Rape, mostly claimed by Women, is predicated upon the Pontification of Sexual-Agency/Autonomy. Meaning, the Concept of “Women’s-Liberation”/Feminism, fuels this. With that being said, anything which is classically understood via at-Tanzīl/Revelation, Historical-Norms via Human-Societies/Civilizations, etc. is falsely classified as Misogyny. In the case of “Marital-Rape”, this is abundantly obvious. Islāmically, in spite of the Fact that Marital-Rape is a Real-Thing, it most definitely isn’t predicated upon Feminists-Views. And, this is exclusively because of the Nature of an-Nikāh/Marriage itself. As per ash-Sharī`ah: an-Nikāh is a Religio-Sexual Commitment between Man&Woman, predicated upon at-Tanzīl. In fact, ironically: the Etymology of the Word “Nikāh” is literally al-Jinsiyyah (Sexuality/Sexual-Intercourse). By definition, Sexual-Intercourse is the Most-Rudiment/Foundational Dimension of any Marriage, so much so that if one is Sexually-Dissatisfied then that alone is Valid-Grounds for Marital-Annulment: this literally applies to both Men & Women. Allah details clearly, via The Qur’ān, that Sexual-Gratification is a Marital-Right/Expectation for both Man & Woman equally, and neither Woman nor Man is Islāmically justified to deny one another Sexual-Appeasement, as Muhammad (Peace be upon them) mentioned: “Approach them whenever/however you will, feed them what you feed yourselves, clothe them however you clothe yourselves, don’t disrespect them, don’t strike/beat them.”.

Proving Marital-Rape

What constitutes Marital-Rape according to ash-Sharī`ah can only be based on 3-Things: a. If one is forced to have Sex after being abused…b. If one is forced to have Sex while experiencing Illness…c. If one is forced to comply with participating in Islāmically-Prohibited Acts.

a. Abuse:

To abuse someone (physically, psycho-emotionally, etc.) & then to press them for Sex realistically counts as Marital-Rape, based on the Statement of Muhammad (Peace be upon them): “How dare any of you beat their Wives, as if they’re a Slave or a Beast, then expect them to be warm towards you sexually?!!!”.

b. Illness:

It’s Mahrūm/Islāmically-Prohibited to force one’s Spouse to engage in Sex while they’re Ill is in fact Marital-Rape. For the Record: a Woman experiencing their Menstrual-Cycle counts as al-Mardh (Illness/Sickness), as Allah states: “And don’t approach them, until after they purify/clear themselves (after their Menstrual-Cycle ceases).”.

c. Sexual-Prohibition:

To force one’s Spouse to commit and/or comply with Things like: al-Liwāt/Sodomy (Anal-Sex), Orgies, Prostitution, etc. is a Valid-Case for Marital-Rape.

Marital-Rape Exaggerations

Now, how’s it even possible for anyone to actually prove that Marital-Rape, even as per the Aforementioned-Conditions, actually took place?!!! That’s the challenge, to be able to prove it. This is where it gets very complex/complicated. And, one Particular-Example of this is a Husband enjoying their Wife while they’re asleep. Ironically enough, there’s actually those whom would actually consider something like this to constitute as “Marital-Rape”…Islāmically something like this most definitely doesn’t fall under Marital-Rape inherently by the way. I’ve literally counseled Men whose Wives have literally accused them of “Marital-Rape”, resulting from them wanting Sex while the Woman is asleep. This is honestly quite ridiculous though. I mean, that’s literally like any Husband crying “Marital-Rape”, resultung from their Wife giving them Blowjobs while they’re asleep…like seriously, really?!!! Also, even if/when any Woman can prove Marital-Rape: exactly what Kind/Type of Hadd/Islāmic-Punishment does one actually expect that their Spouse receive?!!! Because, afterall, the Hadd for al-Ightisāb is Death-Penalty.

Retribution for Marital-Rape

Realistically, external of any Secular-Law: there’s actually 0 Revelatory/Textual Hadd for Marital-Rape, in spite of it definitely being Islāmically-Wrong. And, in All-Truthfulness, there’s plenty of Other-Sins which don’t have any Mundane-Hudūd/Islāmic-Punishments attached to them (like purposely not fasting via the Month of Ramadhān, purposely not making al-Hajj/Pilgrimage, an-Namīmah/Backbiting, etc.). However, via the Ākhirah/Hereafter, Allah will choose whether or not Allah will forgive/pardon vs. shun/punish those whom commit this. Because, surely, no one will escape the Qist/Justice of Allah. Anything/everything which is done Allah knows it, records it, will press those whom do it, as They mention regarding al-Mujrimūn/the Criminals: “What Kind/Type of Book is this (their own Record of Deeds) which leaves nothin small nor large, expect that it’s been enumerated/recorded?!!!”.

Clearly, there’s going to be People who’ll despise what I’ve presented via This-Article & of course: Controversy isn’t something which I’m foreign to, nor am I shy from. However, I must be Muslim-1st. And, via being Muslim-1st, I’ll most definitely piss People off & I’m OK with that. Besides, I’m Smart/Wise enough to know what I always tell People: Controversy is the Best-Publicity.

The World watched-on, as Putin postured very similarly to the likes of: Hitler, Mussolini, Tojo, etc. sweeping across the Crimea. It’s literally like reliving 1939 all over again, as the 3rd-Reich mowed over Poland via World-War II. Russia has been condemned for this naturally. However, it’s in fact ironic who’s leading the Charge to condemn Russia in the 1st-Place: the US & Israel. Both these Nation-States have literally done the Same-Things via their Histories. The US annexing the Entirety of what’s now the United States via the “Indian-Wars”…Israel annexing of the Sinai-Peninsula, the West-Bank, the Golan-Heights, etc. via the “Arab-Israeli Wars” from the 1950’s-1970’s…the US invading/occupying: Vietnam, Laos, Cambodia, Somalia, Libya, Iraq, Afghanistan, etc. Also, assisting their Allies to drone/bomb Syria & Yemen to Death. This is supposed to be “tolerable/acceptable”, while they’ve the Audacity to judge the Actions of Russia?!!!

Everyone deserves Guidance

Allah states:

“The Qur’ān was revealed via the Month-Of-Ramadhān: within it is Guidance for Humanity.”
(Noble-Qur’ān: Chpt.2, V.185)

The Reason how/why I chose to post this is simply to stress the Point that: regardless of how sinful any Person may be, regardless of the Sinful-Lifestyle anyone leads, etc. every Human is Islāmically-Entitled/Justified to be exposed to al-Hidāyah/al-Hudā (Guidance). As Allah states:

a. And never let your hatred, against any People, prevent you from behaving justly.
(Noble-Qur’ān: Chpt.5, V.8)

b. Say: “Oh, My Servants who’ve oppressed themselves: don’t flee from the Mercy-Of-Allah. Verily, Allah forgives All-Sins. Verily, They’re The All-Forgiving The Most-Merciful.”.
(Noble-Qur’ān: Chpt.39, V.53)

Ironically, there’s Muslims whom attempt to favor Certain-Sins over Other-Sins. But, via All-Reality: none of us have any Islāmic-Entitlement to pontificate/claim which Sins are so-called “Better vs. Worse”. Now, it’s absolutely true/honest that Sins are Islāmically-Categorized as Major-Sins & Minor-Sins. But, so what?!!! A Sin is still a Sin, regardless of whether or not it’s classified as Minor or Major…the Point is to avoid al-Fusūq/Sinning holistically, not to pick&choose which Sins we personally disfavor & then condemn those whom commit the Sins we personally dislike. Moreover, we ourselves, more often than not: may very well be committing more Minor-Sins than anyone committing Major-Sins, or we may be committing Major-Sins which we may not even know/care are Major-Sins, or we may be committing Major-Sins only because we think/feel they’re “only Minor-Sins”. It’s like the Ole-Saying goes, “Don’t judge someone, just because they sin differently than you do.”. And, it’s like I always tell People: It’s easy to judge People, when our Sins aren’t Public-Knowledge.

The most Dynamic-Portion, of This-Video, was when it was stated that this Muslim-Person was discouraged from becoming a Muslim. The Question is how/why. The Answer is very simple…it’s from the Waswās/Deception of ash-Shaytān. ash-Shaytān, from the Time the Soul of Adam: the Progenitor/Patriarch-Of-Humanity (Peace be upon them) was created, has utterly despised Humanity. And they even swore to Allah, that they’d do anything to lead/keep Humanity misguided. The Mentality of the True-Muslim towards a Fellow-Muslim

This is literally where the Islāmic-Principle, “Truth is Truth, regardless of whom/where it comes from.”.

In spite of the Fact that the Person featured in This-Video, Mysonne Linen, is a Non-Muslim: principally there’s a lot which Muslims must/can learn from this Video-Clip. What was articulated via This-Video is precisely what al-Islām pontificates/promotes as per Religio-Spiritual Fraternity towards Fellow-Muslims. And, ironically, Muslims are supposed to implement what’s detailed within This-Video more than any other Human-Being. However, sadly, at Times we implement this the least if at all.

One of the most Heartbreaking-Realities which I’ve endured, witnessed, observed, etc. is that there’s Muslims all across the Muslim-World who’ve unshamefully spilled the Blood of Fellow-Muslims: from the 1st-Killing via Human-History at the Hands of Qābīl/Cain when they murdered their Brother Hābīl/Abel, to the Assassination of `Uthmān ibn-`Affān (May Allah be pleased with them) which was the Catalyst for the Civil-War between `Alī ibn-`Imrān & Mu`āwiyah ibn-Sakhr (May Allah be pleased with them both), to the Massacre of Karbalā’ in which Several-Relatives of Muhammad (Peace be upon them) including their Maternal-Grandson al-Husayn ibn-`Alī (May Allah be pleased with them) were slaughtered, to the Invasion of the Muslim-Armies of Northern-Africa into the Muslim-Empires of Muslim-Iberia & Western-Africa, to the Muslim-Arabs assisting Non-Muslim/Western Powers to destroy al-Khilāfah/Islāmic-Governance via the Ottoman-Empire, to Muslim-Countries assisting Non-Muslim Countries invade/occupy & terrorize Fellow Muslim-Countries, etc., from Philadelphia, PA to NYC, NY…there’s Countless-Examples of how Muslims blatantly kill Other-Muslims.

I’ve been very vocal, in terms of my Advocacy of Sexual-Abuse Awareness/Prevention. Also, I’ve constantly/consistently been working with Individuals, Entities, Organizations, etc. as per spreading Awareness/Education about how to educate Others to confront/combat Sexual-Abuse. While doing one of my Presentations, I was faced with Lots of Audience-Questions after my Presentation which I wasn’t able to answer immediately. But, when I was sent these Questions thereafter, I didn’t hesitate to respond to them.

The Questions&Answers:

1. How can I become more aware (are there trainings or classes) as to what Sexual-Abuse is and how can I help prevent it? There’s Seminars, Lectures, Classes, etc. especially Online-Resources, regarding Sexual-Abuse Education.

2. I’ve always understood Sexual-Abuse to be a Crime-Of-Power/Control. Can you explain in more detail your Statement of it being one of Hatred? Yes…as per the Nature of Sexual-Abuse itself, only someone whom hates a Fellow-Human would sexually abuse them. There’s nothing pleasant or loving, regarding Sexual-Abuse: it’s exclusively predicated upon Malice.

3. How can I begin putting Supporting-Initiatives in my Place-Of-Worship for Sexual-Abuse Survivors? Good-Question…Answer: publicize that you self-identify the Issue & will not be silent about it, because like I always tell People: Silence is Compliance. Begin with those whom you know and/or are close to, whom’re either Sexual-Abuse Survivors themselves or are connected to/with Sexual-Abuse Survivors. And, then formulate Support-Groups: schedule these Support-Groups at your respective Places-Of-Worship, as a Warning against Sexual-Abusers/Predators whom use Places of Worship to seek-out their Sexual-Victims/Prey.

4. How can I help those in Leadership-Positions, those in Authority, etc. understand the Need for Support-Initiatives in our various Places-Of-Worship? You can help by taking the Lead, as per formulating Support-Groups, Neighborhood-Watch Groups, Sexual-Abuse Hotlines, becoming Community-Board Members, etc.

5. Now that the Alarm has been sounded, and the Conversation started, what are the next steps? Good-Question…Answer: do whatever’s in one’s Individual-Capacity, to get involved in spreading Sexual-Abuse Awareness/Education.

6. Because I was Sexually-Abused, does that mean I could become a Sexual-Abuser? Also, Men whom’re Sexual-Abuse Suvivors: are they just as ashamed and repulsed as Women whom’re Sexual-Abuse Survivors? 1st-Question: Not necessarily/exclusively, but it can most definitely occur & it has occured and it still occurs. Any Manifestation of Abuse is a Cycle…for Some/Many-People, they’re unwilling to have an Abuse-Cycle end with them. And, as a Result of that, they end-up becoming an Abuser themselves to impose the Same-Trauma upon Others which was imposed upon themselves. I’ve personally counseled Sexual-Predators whom themselves were sexually-abused themselves. 2nd-Question: There’s Some/Many-Men whom experience the Same-Types/Kinds of Trauma which any Woman may experience via Sexual-Abuse. Or, literally, because of the Fragility of the Human-Male Ego: they may experience a Deeper-Severity of Trauma.

7. Sexual-Abusers seldom get Prison-Time.  Can you speak a little more on why? No…it’s not that Sexual-Abusers seldomly get arrested, prosecuted, convicted, Prison-Time, etc. However, what’s a Statistical-Fact is that (via the United States especially) the Average Child-Molester, Rapist, etc. barely gets Death-Penalty Sentencing or Sentencing which is more than a Decade. Ironically, via the US, the Average Sexual-Abuser is always a: Non-Muslim, Euro-Male, Ages 20-60. Also, there’s so many Sexual-Abusers whom never get reported to Law-Enforcement.

8. Sexual-Abuse and Pornography. If I enjoy Porn, how likely is it that I will sexually abuse someone? Good-Question…Answer: that exclusively depends upon the Spiritual-Principle/Integrity of any/every Individual, as well as depending upon the Psycho-Emotional Constitution of any/every Individual. Pornography, for the Record, isn’t positive anyway: for Obvious-Reasons. Pornography inherently formulates in the Minds/Hearts of People that their Exclusive Human-Value is relugated to them being Sexual-Objects. And, once People get to That-Space/Place, their Sexual-Targets will potential hone in on anyone. The Porn-Industry literally caters to any/every Sexual-Fetish ever known to Man…this is Fact, not Fiction. There’s literally Porn-Sites, Porn-Categories, etc. which exclusively/categorically pontificate&promote Sexual-Abuse.

9. What’s the Connection between Sexual-Abuse & Suicide? Good-Question…Answer: the Correlation/Connection between Suicide & Sexual-Abuse pertains to Self-Resentment, Self-Shame, Self-Blame/Fault, etc. More often than not: Sexual-Abuse Survivors allow themselves to think/feel that they’re the Reason how/why they were sexually-abused. Also, they’re fearful of getting penalized, ostracized, etc. for being vocal regarding Sexual-Abuse. These are Realities: there’s Certain-Places in the World, where if anyone is vocal pertaining to being sexually-abused they could be murdered…their Loved-Ones could face the Same-Fate…they could be forced to marry their Sexual-Abuser…they could be forced to move to Another-Place…they could be forced into Prostitution…etc.

10. I was assaulted as a child. Where do I go from here? Firstly, let me say that I regret that your were sexually-abused. Secondly, you individually never deserved to be sexually-abused, regardless of whatever you did, presented yourself, behaved, etc. Thirdly, you’re not alone…Persons like myself are in fact here to empathize & support you: we’re here to listen to you & to not be judgmental towards/against you. Now, as per where do you go from here…that’s a Good-Question. It seems clear that you desire to arrive at a Space/Place of Healing. 

These-Types/Kinds of Questions are never easy to answer. And, sometimes, it may seem as thoygh there’s no such Thing as the Right/Best-Answer. It’s a Constant-Challenge, pertaining to This-Issue. And the Fact that it’s so prevalent via our Modern-Society is very telling, as per how much Work must be done to confront Sexual-Abuse.
